"I think you're drunk -- you are under arrest"!


It just doesn't sound like something that can really happen, but it does .. a lot. People are arrested for public intoxication, without any more than an officer "suspecting" they are drunk. Of course, the officer is supposed to smell alcohol, see blood shot eyes or hear slurred speech -- but, come on face it, all the cop really has to do is tag you as drunk and off you go to jail.

That is what witnesses say happened during the raid at the Rainbow Lounge in Fort Worth. Many say people who weren't even drinking were handcuffed and arrested, just because they were in the bar. Of course, defense attorneys cry foul on this one. One attorney calls it a "crime of opinion" -- and that opinion belongs to the officer.

It seems like there should be more checks and balances -- perhaps an officer should be mandated to do at least a field sobriety test before loading someone up and taking them to the drunk tank .. not to mention the heafty fine that goes with it. This just smells wrong, doesn't it?

can we stop refering to it as a "raid"? it was a routine tabc inspection that went terrible wrong. this only feeds the fire of misinformation...
