Cheating on the TAKS test!

Today the DISD turned in its internal investigation regarding testing irregularities at Lang Middle School to the Texas Education Agency. Bottom line, the tests were left unlocked in an unsecure location.  The people responsible for securing those locations are the principal, the test coordinator and the janitor(s), according to DISD.   Superintendent Michael Hinojosa says there is no clear evidence that's points to one responsible party, only that over night someone erased and changed answers on the TAKS test documents.

Former Principal Robert Peters and the test coordinator both stepped down earlier this year. DISD says "they have not responded to OPR's (Office of Professional Responsibility) email and telephone requests for assistance with the investigation.

Rape Survivors Applaude Controversial New Law

You only have to listen to Lavinia Masters a few minutes to realize what an inspiration she is. At 13, she was raped by a man who broke into her West Dallas home. Decades later she finally learned the identity of the man who took her innocence, but it was too late to prosecute.

But, finally Masters and other survivors will get their justice with a new law. The law requires that suspected rapists -- tagged by DNA -- get a permanent mark on their records, that will be seen by prosecutors and parole officials. The mark could impact jail terms and parole release.

So what do you think about this first of it's kind law? ... Does it go too far in denying due process, as some ACLU critics claim? Let me know what you think.

All School Zones Are Not Created Equal

Despite, a statewide ban on handheld cell phone use in activated school zones, some police departments are not enforcing the law.

"What?", you ask.

The return of swine flu, er, H1N1

The CDC was on it. Health officials there said to brace for a return of the swine flu this fall. Especially when school starts. Boy were they right. TCU had a couple dozen cases last week and this week it's Carroll ISD's turn. Today about 30 kids were at home with what is believed to be H1N1. It started with one kid on Friday and by Wednesday the number had grown to more than two dozen. It can spread quickly. In contrast to last spring, no schools are closing, at least not yet. This fall, it's a sliding scale. Let's hope it's H1N1 that scales back.

Dove Hunting

I spent the morning, early morning, with four dove hunters today. This was the first time I have ever been dove hunting. It was really exciting. The guys were really good and they didn't seem to use much effort hit their targets. I had heard that there was concern over hunters getting too close to residential neighborhoods and schools but all the hunters I saw played by the rules.

Dove Hunting

I was surprised that doves are so small. No wonder the hunters shoot so much, It probably takes five or six birds to fill them at one meal. They tell me that doves have all dark meat. I watched as the gentlemen cleaned the birds and let me just say that part was not very appealing. I would like to try dove meat. I'm sure its really good, But, I would like to purchase it at a restaurant.

SMU Football sells out the season opener

Smu-logo.gifI have to say one thing about June Jones, he's always been an optimist.  He said last month that SMU would sell out the home opener against Stephen F. Austin and tonight, two nights before the game, the school says 32,000 seats at Gerald J. Ford Stadium are sold making the game an official sell out.

"We talk about `believing' with our team, and I had asked everyone in the community to believe that we would sell out this game," said Head Coach June Jones. "We've done that. It will be great for our kids to run out into a stadium full of our SMU fans, and our team will feed off their energy. As I've said, it's an exciting time to be a part of SMU football."

The school put together a committee that asked different Dallas businesses to purchase 1,000 tickets a piece and then either sell the tickets or give them away.  Many tickets will go to youth organizations and high school students.

The all time record at Ford Stadium is 34,689 and the Mustangs have created some new
seating areas which could help this crowd set a new record and Athletic Director Steve Orsini believes it will happen. 

"We want to thank everyone who was involved in this effort," said Orsini. "This historic effort is a tribute to our Sellout 2009 committee and our ticket sales staff. While we're sold out, I believe that we will also break our record for the largest crowd in Ford Stadium history."

Kickoff is 7:00pm and the gates to the Ford Stadium open at 5:30pm.

Timing is everything

I know, I know. We need the rain. But not on Thursday. I know I'm being selfish, but I mow my lawn on Friday mornings. You see, when it rains on Thursday I can't mow my lawn before I come to work. It may sound like nothing, but it REALLY screws up my weekend. Call me crazy, but on weekends, I like to do nothing. Zero. Zip. My weekdays are all about getting things done in a timely fashion. I don't like to brag, but on weekends, I challenge anyone to do less than myself. I'm really very, very good at it. Ask my wife, she'll tell you. But on Saturday, I'll be getting up and mowing the lawn. Timing is everything and Mother Nature needs a Timex.

Help Is On The Way

As the wildfires continue to burn across California dozens of states are lending a hand to help, but not Texas. That's because Texas is no better off according to the Texas Forest Service in Granbury.
Conditions are so bad firefighters and equipment from twenty-nine states have responded to Texas since July.
I'm told when manpower gets low an agency in Boise, Idaho helps to coordinate national resources for states hard hit by wildfires.
Coincidentally volunteers from California had been helping in Texas earlier this summer, but now it their turn.
Thousands of firefighters from around the nation have responded to the Golden State, including another 2600 trained prison inmates.
Once the flames are doused, it's onto the next wildfire, no matter where it is, such is the life of a smoke-jumper.

Hartelijk gefeliciteerd Pelps!

Today is Pelpina Trip's Birthday. And today was by far the BIGGEST office birthday party we have had since I've been working here. Pelpina is from the Netherlands. She explained to me that in the Netherlands you celebrate your birthday by bringing yourself food to work or school! So today, on her birthday, she brought doughnuts, cookies, and cupcakes... for herself! (and everyone to share)
 
Little did she know that Jennifer Shrum, the head web producer, was about to BLOW out her big day. She really went all out. Jennifer brought a cake, streamers, a huge card, banners... and decorated Pelpina's entire desk.
 
The newsroom was on a sugar high the ENTIRE day.
 
Netherlands Birthday Traditions + American Birthday Traditions = a whole lot of calories.

Dallas Furloughs

I wish my job would give me a furlough..lol. Just kidding. But, you have to admit this would really be nice if your employer decided to give you a few days off to save money. Now, I know they are not paid days, but sometimes you just need a lazy day to catch up on your rest. I'm telling we all work way too hard sometimes. Lets just all go move to a four day work week!!

Dallas Furloughs

This city of Dallas is not alone in this endeavor, I've read about other cities doing the same thing. Its amazing how much money can be saved by just shutting down for one day.
Keep in mind that the zoo is still open. And of course emergency services, police, fire, etc. will still be working.

Expanded Mandatory Blood Draws ... What do you think?

So, police now have more power to take blood from suspected drunk, without permission or a warrant. There are several new categories -- including repeat offenders and those driving with children in the car. This concept has come under fire from critics, who challenge the way the blood is collected, transported and stored -- along with privacy issues.

But so far, the courts have sided with police and prosecutors. Opponents have not found a way to poke holes in the law. What do you think?

Bring it on

I'm talking about the weekend. I've been spent since my trip to California last week. I left WAY early Thursday morning and didn't get back until LATE Sunday night. Monday came fast and I've been treading water since. Just flat-out tired. Some weeks just fly by with good stories lined up. Not this week. Headwinds all the way courtesy of my west coast trip. The Courage of a Mother

I spoke with a woman yesterday who accidentally ran over one of her own children with a car this weekend. It's a kind of grief, a depth of grief none of us should presume to be able to understand. Period.

Sandra spoke to me with so much grace and poise that even now, a day later, I struggle to believe it. She was at times difficult to understand through the sobbing. Hers was gut-wrenching, feel-it-down-to-your-knees, can't control herself, sadness.

She showed me her "angel's" picture. It was a beautiful family portrait in which the boy's mouth was open in a laugh and his eyes sparkled. You could easily see why she sees him as that angel.

Sandra and family...you are in my thoughts. I wish you peace.

Two days and counting

You know what I'm talking about! The NFL season kicks off on Thursday. I love it. I haven't played fantasy football in several years, but many here in the newroom are in a league and the draft and trading is already underway. I got tired of losing my $100.00 a season. I decided I could use that money to get the Sunday Ticket (Yes, I have to pay through the nose to see my 49ers lose). So this season I can dream of the 49ers golden years and get a kick out of my newsroom friends trying to decide which players to start. As for me, I start watching on Sunday.

Exonerees Become Instant Millionaires

Finally -- after years in prison for crimes they didn't commit, Texas exonerees are getting their due. Many of the wrongly-convicted will receive million, under a new state compensation law that gives exonerees $80,000 for every year spent behind bars.

Johnnie Lindsey is in line to receive more than 2 million -- after spending 26 years in prison for a rape he didn't do. He says he is satisfied, but no completly happy that he won't get his day in court -- to tell his story. Lindsey says he will spend the money wisely. But, he quickly adds that if he had to choose the money or not going to prison -- he would chose never to go to prison.

I think that is probably a given -- who would spend years behind bars in exchange for millions -- not many. There is not enough money to compensate these men for what they went through, but at least this is a start.

Flavored Cigarettes

Before I had started this story I had not realized that a federal ban is on the way. I have noticed a lot more tobacco products on the shelves these days...sour apple, cream, grape, give me a break. I do think they can be appealing to children. A tobacco store clerk pointed out to me that under age tobacco purchasing has really been cracked down on lately.

Flavored Cigarettes

Across the state there has been increase in the price of single cigars. Its was brought out earlier this year by the Dallas city council that they are often used to roll up drugs. That concern has still not left. The American Heart Association also points out that whether the tobacco tastes good or not, the risk for cancer is still there.

Health Care Reform!

I say do it now! If not for any other reason, I'm tired of hearing about it. I'm tired of people on one side distorting the proposed plans and I'm tired of the other side not clearly detailing what's in the plan. As a reporter, I like the debate because it gives me lots of good stories. As an American, I have no idea if president Obama's plan is good or bad. I think most people understand that something needs to be done, but they're not sure exactly what. I say this to members of Congress: Do it now, because I'm ready for another topic. Me? I'm taking a Nike stance, Just Do It. Reform health care, and if it doesn't work, go back to the way it was before or try something else. Who says government programs have to last forever?

Hijacking, Still A Threat

  Do they really look like this?

   Terrifying moments for passengers on board a hijacked jet in Mexico. Authorities stormed the plane, and the crew emerged unharmed moments later.  I was surprised to learn, despite the increased security at airports across the globe, hijackings are still a big problem.
   In 2007 4 jets were taken over by terrorist and in 2008 Two men hijacked a plane in Sudan. In 2009 a Canadian plane carrying 159 passengers was taken over. Almost all ended without bloodshed but only thanks to the response by officials.
   Many get their training from TSA experts who help review and identify potential threats
and make recommendations.

Operation Comeback

This is the second Mayor sponsored event I've been to in the city of Dallas. I really like to see city officials involved in the day to day process. According to the East Texas Review, every hour 93 students drop out of Texas schools. A majority of these are inner city minority males. Close to one third of all high schoolers in Texas schools will fail to graduate.

Operation Comeback

Here is some interesting information I found out today. It offers a different perspective that students may not think about. High school dropouts: Not only are their own economic prospects hindered, but they also prove to be a drain on the local economy. The Dallas based National Center for Policy Analysis (NCPA) says that in 2007 alone the number of high schools dropouts from Texas schools will costs the state 377 million dollars.

Cowboys Name Captains for the Season

It's officially Tony Romo's team now.  For the first time, Tony's teammates voted him as one of the four captains on this squad.  He will be joined by Jason Witten representing the offense at the coin toss.  Bradie James and DeMarcus Ware are the defensive captains and whoever is named the MVP of the special teams from the game before, will represent that unit the next game.

Regardless of how many Cowboy fans believe that leadership isn't that strong on this team, Wade Phillips is thrilled with men who will lead his group.  "We have good leaders here" said Phillips. "They work hard, they encourage their teammates, know what to do, and that's important.  Bradie knows all the defenses,  when guys make mistakes and Tony, offensively knows all those things so you have guys like that can say things and correct things on the field when the coaches are out there."

The Cowboys open the season Sunday in Tampa with a 12 noon kickoff.  We will be there and will bring you complete highlights and reaction from the locker room Sunday night on Inside Sports at 9:30pm.

Painkiller Contracts

You know it's seroius when you have to sign a contract. These days, so many people are getting hooked on prescription painkillers that doctors are making patients sign a painkiller contract. The contract stipulates that the patient will only take the medication as prescribed, not give it to anyone else and not shop around for other pills. There has been a lot of talk about electronic health records. It may help streamline and make doctors and hospitals keep track of things better, but I'm told they won't help prescription medication abuse. Here's the deal: The only way doctors can track a patients prescription history, is if every doctor or hospital or clinic or practice is on the same system. That way a doctor could log on and say, Mr. Carpenter, it says here you got a prescription filled two days ago at so-and-so pharmacy. Whoops, I'm busted. But guess what? Most hosptials, clinics and practices are on different systems. Which brings us back to the painkiller contract. It's a nice try and may help, but it's also not legally binding, which makes it worth the paper it's printed on.

Photographer makes good on a promise to homeless man

 

  bj.jpgIn 1985 BJ Lacasse was new to Ft. Worth.  She was a green photographer who wanted to take shots of her new city at dusk.  So, when she could, BJ would shoot around Ft. Worth between 4pm and 7pm, shooting buildings, The Stockyards, sunsets and people.  But, it was one person, Johnny, who touched her heart.  Johnny was a homeless man.  BJ and Johnny became friends and BJ would run into him from time to time.  One day Johnny asked BJ to make a promise to him.  He asked her to document with dignity the lives of the homeless people in Ft. Worth.  He gave her a pen and said when you make it big and you have the influence to change lives, tell our story.  Now, as a successful published photographer, BJ said to herself, its time.  Twenty four years later, BJ Lacasse is making good on her promise to Johnny.  She spent three days on the streets of Ft. Worth in the swealtering Texas heat documenting the lives of the homeless.  Her photo exhibit opens Saturday, September 12th from 4 to 8 p.m. at Museum Place, 3100 Seventh St.  All proceeds from prints and donations will benefit the Presbyterian Night Shelter in Ft. Worth.

Bird Mess

I've been doing tv news for ten years, but this is the first story I've done on bird mess. We were unsure is I'd be able to find any feathers around the area in Frisco because its been raining since yesterday. But, I had no problem finding them. I can only imagine how many feathers were on the ground before the rain had come through. After doing some investigating we determined that they are mostly Grackles with a few pigeons mixed in.

Bird Mess

Grackles are here year round in Texas. Common Grackles are blackbirds that look like they've been slightly stretched. They're taller and longer tailed than a typical blackbird, with a longer, more tapered bill and glossy-iridescent bodies. Grackles walk around lawns and fields on their long legs or gather in noisy groups high in trees, typically evergreens. I am also told that there was similar problem near Fort Worth. In the past fireworks, even guns have been used to rid the area of them.

Remembering the Lost Heroes

I think I could have listed to Chief Rick Lasky talk all day. The Lewisville fire chief lost 11 close friends during the attacks of 9/11 -- all of them firefighters who rushed into the burning towers, while people went screaming the other way.

He talks about the many lasting contributions these outstanding men left behind -- the tools and techniques that are still being used/taught today. It is inspiring to hear Lasky describe his friends who loved the fire service. He told me that he couldn't watch the documentary, "9/11" because he could see the faces of many of his friends, who did not return. Imagine seeing the last moments of a friend's life captured on videotape. 

The lesson that I take away form Lasky is to remember and never forget. Let these heroes be part of your thoughts here and there -- remember their sacrifices.

Did a sleep study story today

I did a sleep study story today. I think it might actually help people who have a hard time sleeping. Researchers say that the best temperature range to fall asleep is somewhere between 60 and 68 degrees. The best range to remain sleeping is somewhere between 68 and 75. That's what I like about being a health reporter, some of the stories I do may actually help someone. It that regard, it was a pretty good week. On Tuesday I did a story about ADHD and how scientists now think they may have honed in on why people have a hard time concentrating. Now, where was I? Oh yea. On Thursday I wrote a story on how many doctors now require at-risk patients to sign a painkiller contract that stipulates guidelines on how to use the medication. They do it because painkillers are so addictive and often abused. On Monday I did a story about country music stars playing acoustic sets to raise money for a neonatal unit in Fort Worth. I had a good week. After tonight's sleep story, rest asured, I'll sleep like a baby.

Roof Collapse

This family really had a bad day. They say they had been calling management but no responded. There are four little boys that call the apartment home. The youngest is about a year old, the oldest about six. Despite all the news crews that were in their apartment, they were in pretty good spirits. In fact, we had trouble getting some interviews because the boys were playing. Kids can be so funny sometimes.

Roof Collapse

I had some time to talk with the roofer that inspected the damage. He says this type of thing can happen quite quickly. It doesn't take much water to cause a lot of damage. In an apartment it can go unnoticed a lot longer because tenants are always coming and going. The family I interviewed said they had only been living there for seven months. They did not have renters insurance. That is a lesson for all of us..including me. The Dunn's also say they would like to move.

Showing Strength

A Ft. Worth church mourned and celebrated with 2 services today.  They marked the 10 year anniversary of a shooting rampage there that killed 7 people and wounded 7 others.

The celebrating part may be a little confusing on the surface, but it makes perfect sense having met some of the congregation members.

The Darkness has not overcome the Light

That's the sentiment from members of the Wedgwood Baptist Church in Fort Worth.  This Tuesday, September 15 will mark 10 years to the day when a "disturbed" gunman walked into the church's Sanctuary and killed 7 people.

That man's name was Larry Gene Ashbrook.  Pastor Al Meredith told me, that at the time of the shooting he felt the suspect's family needed ministry and he reached out to them. The congregation and the Ashbrook family have healed together over the last decade.

The following is a letter written by Aaron Ashbrook, the killer's brother, to the congregation on the 10th anniversary.

True Forgiveness

 

I have never experienced the forgiveness that I received from the church at Wedgwood.  How could I have known that one day on my way to work I would hear on the radio that there had been a shooting at Wedgwood and my brother was involved?  How could I have known that the families involved in this devastating act would be so loving and forgiving?

 

Although I know Wedgwood was hurting within their church body, they reached out to us and surrounded us with love and forgiveness.  Because of their love and ultimate forgiveness to us, we were able to heal in time.  As I sat in the church on the first anniversary and listened to those who forgave my brother for his act and violence, I was surrounded with love and kindness.  We did not know what lay ahead of us but we did know that we had been forgiven from any wrong.

 

As the years have gone by, I think of my brother and what he did and that ultimately changed so many lives.  No one's life would ever be the same.  We have all faced many hardships because of Larry's act but as time goes by the hurt and pain lessen.  The memory, the pain, the hurt will never go away, but the power of love arises to the surface to carry through even today.

 

I think of Christ as he hung on the cross over 2000 years ago saying forgive them for they know not what they do.  That is what you did for Larry on that day in September of 1999.  You forgave him and you forgave us and for that we will ever be grateful.

Swine Flu Stigma?

Tens of thousands of people are expected to come down with the swine flu this winter, but is there a stigma attached to the virus? At least one North Texas mother who recently had the swine flu, along with her two toddlers, thinks so. The woman, who does not want to be identified, says her husband is very concerned about perceptions surrounding the swine flu.

He didn't want their kids' schools to know the children had H1N1. The couple was concerned about what teachers might think and whether parents might think the children were still contagious long after they recovered.

Doctors seem to agree that their is some shame or embarassment associated with the swine flu ... probably because of the name many people think it's associated with eating pork or not keeping a tidy house.

H1N1 Reality

We keep hearing the swine flu is mild, pretty much like the season flu. It all sounds so good, until someone dies, then it doesn't so mild. I can't imagine how the Garcia family is feeling tonight. Their eleven year old daughter, Cynthia, died this weekend. Dallas County health officials have confirmed she was infected with H1N1. She had no underlying health conditions. Cynthia went home Thursday with flu-like symptoms, she was dead by Saturday night. I've done a bunch of H1N1 stories over the past ten months, this one is both a wakeup call and heartbreaker.

Dallas Dries Out

Well, we set out this afternoon in search of expected flooding, even drenched West Dallas'ites who might be preparing to evacuate their low lying homes because of the recent rain.  

Police had gone door to door last night warning of high water and some residents got Reverse 911 calls as late as 2am.

Flooding and evacuations were a distinct possibility today with yet more rain in the forecast.  

We didn't get it.  That's okay; I'll take good news any day.  Sometimes in this business a good part of your day never makes air.

No Safe Place?

I already knew you could slip and hurt yourself in the shower, and now this? A shower head is now dangerous? Apparently so. Researchers studied 45 shower heads in five states (Don't worry, not Texas) and found a dangerous bacteria hidden in the shower heads. Doctors say people with weakened immune systems are at risk, which means most people are safe. Healthy or not, the yuck factor on this story is pretty high. I wonder if I'm going to feel nice and clean tomorrow morning.

Sex Offender Living in a Nursing Home

It is hard to believe that a man the state considers a violent sexual predator is now living in a Lake Worth nursing home. The Lake Worth Nursing facility isn't commenting about it's newest resident, Boyd Mullens, but neighbors are.

Many of them are outraged that Mullens, a convicted child molester, was moved to the facility after becoming ill. Even experts agree that sex offenders under civil committment are to be considered very dangerous, despite age or health. Mullens is 60-years old.

What is most disturbing is the idea that residents and their families may not have any idea about Mullens and his background. A social worker told us "they do not divulge that information to families". Really, there is a dangerous sex criminal living near the elderly and they aren't told? Does that strike you as something that should be remedied by regulation or law? It sure smacks of something that needs changed to me.

Collin County Outer Loop

Right now there are 750-thousand people in Collin county. By 2024 that number is expected to jump to 2.2 million. Those are the reasons being given by the county for the new loop. It will of course be helpful in the long run for everyone but the majority of the loop will be in Collin county.

Collin County Outer Loop

The public meeting will be held Thursday in Nevada at the high school. Start time is 7pm. This will give everyone a chance to sound off about how they feel about the new loop. Some people are against the proposed path...well, suggestions will be taken on where the loop should go.

Show's Over

Producers, anchors, the production crew are all back in the newsroom. The show must be over. It's amazing how quiet the newroom is when the show is in progress. Don't get me wrong, when things go haywire, it can get noisy in a big way, but generally it's so quiet you can hear a pin drop. That of course makes it a good time to rewrite the broadcast story for The33TV.com, then blog, which is what I am doing now. I've gotten pretty good at writing in a newsroom full of chatter and blaring televisions. In a strange way, blogging after the show is actually soothing, or maybe it's because I know that soon, I'll be going home. Make that now. See you tomorrow.

Cell Phone Ban

While this is a state law its up to each individual city how they will enforce it. Its not a cheap process...In the Plano for instance they are purchasing 1300 signs to go across the city, it will cost $80,000. For a city its not that much money, but every bit counts when, especially when so many cities are dealing with shortfalls on budgets.

Cell Phone Ban

Speed Measurement Labs provided all the research for this topic. They had some other stats you might find interesting: Data shows female drivers were almost twice as likely to be on their phone, 9.6% as a group compared to male drivers at 5.5 % in active school zones. With that said, its important to note that men are more likely to get into a crash in general than women are. Cell phone use in now the third leading cause of death in Texas and the U.S. The number one reason is drinking, the number two reason is speeding.

Bank Shooting

I started my day driving to Plano to cover the Balloon Festival...while on my way I got the call about this Oak Cliff shooting. I was told one guard had been shot, but the time I got there he was dead. These are always tough stories to do, but you do get used to working these kind of crime scenes in this business. When I got there the victims body was still laying outside near the atm under a covered sheet. While his identity has not yet been released we do know he was a married father of at least one child.

Bank Shooting

What senseless killing this was. I've done previous stories where atm's have been stolen at night...I wonder why these suspects didn't just wait until night and just try stealing the machine. That still would have been bad, but at least a man wouldn't be dead.
Police believe they are looking for two Hispanic men, one of the men may have been white. There was a massive search underway on the ground and in the air.

What to do with the stray animals?

Cities are struggling with finding the dollars to pay for the resources to house and adopt out stray animals. In Keller, you will find a very cramped, crowded, tiny shelter. Officials admit it is outdated, but coming up with the money to remedy the situation is a problem.

City authorities are fairly certain that in these rough, economic times taypayers do not want to foot the bill for a new shelter -- that could stretch into the millions. Some estimate that it will cost $2 million to partner with North Richland Hills on a new shelter.

But, advocates say staying put in the small, outdated facility should also not be an option. Some say it is the animals that are getting the short end of the stick.

In a heartbeat

Life can turn on a dime, end in an instant, be over before we hit the floor. That is basically what happens during Sudden Cardiac Arrest. It's not heart disease, it's a congenital abnormality and when hit with SCA, it's pretty much over. That's what happened to Plano's Zachary Schrah, he finished practice, and then died. His mother has formed an organization called 'Living for Zachary'. It designed to raise awareness about SCA. The organization has joined with Baylor Heart Hospital in Plano and is now offering two screenings, an echocardiogram and and electrocardiogram. I'm told the package ususally cost around $1000.00 dollars, but if you're between the ages of 13 and 22, it's just $100.00. Doctor's say such a test would likely have saved Zachary's lilfe. His mom is still mourning his death, but Living for Zachary.

R-U Ready For Some Football?

  It's hard to believe after all the debate and squabbling the Cowboys are finally set to play their first season game in the new stadium.
   I still remember reporting on some of the early talks with Arlington officials, well before any papers had been signed.  Many had been hoping the City of Dallas would come through with a last minute bid, but by Aug. 04 it was clear Arlington had all but closed the deal.
  In the months to come I interviewed homeowners living in the stadiums path, "We don't know how much money they'll give us or what we're going to do," said one longtime resident.  Many people had threatened to fight but only a few held out for more money. 
  71 year old Evelyn Wray was one of them, she was finally given 1.2 (M) for her four acres. The city initially offered her just 351 thousand. Some thought she did well for herself, but actually her property appraised for twice as much as the final offer.
   I'm not sure what ever happened to Mrs. Wray or the other folks, but I have a feeling they might be cheering for the Giants this time tomorrow.

Kids Hit By Car-Follow Up

Residents on Morrell were a little angry today when I visited. They had seen yesterdays accident and they felt like it didn't have to happen. They would like to see speed bumps or signs put it in to slow drivers down. I didn't say it in my piece, but many residents felt like nobody cared about their neighborhood. Over and over I heard people saying that. As I looked around the street a little bit, at times I felt like I was back in Michigan.

Kids Hit By Car-Follow Up

As for the one child that is still in the hospital...I was only able to get limited information. I was able to find out where the child's mother works and I talked to her employer. He didn't put all her business in the street, but he did say the mother was struggling to deal with this situation. He said she cried while on the phone with him earlier this morning. It sounded like the child may have a little longer to stay in the hospital. I really wish them all well.

Space Shuttle Landing

I've seen a lot in my reporting years, but I've never seen the space shuttle up close. This was really neat and its hard to convey the experience in words. Up close Discovery looks very worn. Its physically dirty and it looks as though the outside had basically been burned by fire. Engineers tell me the exterior of the shuttle is more sensitive than that of airplanes. It can't even be exposed to simple rain.

Space Shuttle Landing

The stop in Fort Worth was not planned...weather forced it. Security is very tight approaching the shuttle, even for media, don't forget we are living in a post 9/11 world. Even we were only permitted to get within 700 feet of the shuttle. The astronauts of course were flown directly back to Houston. The Discovery had been on a 14 day mission to the International Space Station to remove an ammonia tank. Because the shuttle had the is ammonia tank, at each stop inspectors would use devices called 'sniffers' to make sure none of the ammonia was leaking. Most of the staff are engineers and pilots that work for NASA. All of them seemed to really enjoy they're work, they just went on and on. I can only imagine how cool they're job must be.

Cowboys Home Opener sets NFL Record

cowboys stadium 103.jpgThe largest crowd to ever watch an NFL game packed the new Cowboys Stadium for the home opener against the New York Giants.   105,121 fans surpassed the previous high of 103,467 that watched the San Francisco 49ers play the Arizona Cardinals at Aztec Stadium in Mexico City on October 2nd, 2005

Among the fans in the audience, Former President George W. Bush who watched the game next to the former First Lady Laura Bush in Jerry Jones' luxury box.  The former President spent most of the first half sitting next to John Madden and Pat Summerall. 

The halftime ceremony featured the members of the Ring of Honor as the Cowboys unveiled their names that are affixed to the facing of the fourth level.

The best hustle of the day award goes to Troy Aikman who called the Eagles/Saints game in Philadelphia which didn't end until 3:30pm.  Aikman made it to Dallas just before the halftime ceremony.

Cowboys Stadium: Party Foul

Fans attending tonight's regular season home opener told us they loved the stadium, but some didn't get the up close look they thought they deserved.

Police temporarily held up some of the Party Pass crowd trying to get in after the fire department said the standing room area was getting close to capacity.

Severe Weather Tonight

A few storms are already popping up in North Texas, but the biggest ones arrive after 8pm along with a strong cold front.  We are under a severe thunderstorm watch until 11pm (at least) and a flash flood watch through tomorrow morning.

Storms tonight could produce heavy rains, hail and winds gusting over 57mph.  One to three inches of rain are possible.

Temps today reached the low 90s, but it's the last really warm day in awhile.  By Wednesday morning, some of you will drop to the 50s!!!

Pop the Champagne

History was made at the CW33 today.  The station launched its first 5:30pm newscast.  It's quite an accomplishment considering most news outlets are cutting back and eliminating newscasts in this tough economy.  More big changes are coming to The 33 News.  But, today was all about the 5:30 show.  We had a little champagne and celebrated the moment today in the newsroom.   Now, it's time to get back to work.

Should Police Officers Draw a DWI Suspect's Blood?

No doubt there are strong feelings on both sides of question that I posed in the headline. Soon, a 3-judge panel in Tarrant County will offer up a legal opinion.

Arguments are set for Tuesday in the case of a Bedford woman, who challenged the blood evidence in her DWI arrest because it was drawn by two Dalworthington Gardens police officers. The sample was taken in a tiny room at the department called, the "Clean Room".

Her attorney argues that it is unconstitutional for cops to draw blood because it is unreasonable. But the police chief says his officers go through intense training and are always professional. Bill Waybourn says in 500 blood draws they haven't had a problem.

So, we'll see where the appeals court comes down on this. You can bet police departments across the country will be watching to see if the syringe will continue to be allowed as part of their arsenal.

Marion Barber Injury Update

The Cowboys may be without running back Marion Barber for next week's game at Cowboys Stadium. An MRI revealed today that Barber has a strain in his left quad and is listed as questionable for the Monday night show down against The Panthers. The injury occurred in the 4th quarter. Barber went off for 124 yards and a touchdown, before leaving the game.

When it rains, it pours

Monday started out great. I had a great local story lined up in Arlington and Fort Worth. It went down from there. My 4:30 PM interview in Fort Worth started about a half hour late, then the long drive in traffic back to our studio in Dallas. So, I get back here shortly after 6:00 PM, plenty of time to log, write and edit a story. Then the rains came. Rob, our assistant News Director asked for a rain live shot just off of John Carpenter Freeway. No problem, except there was still work to be done on my package that ran later in the show. So anyway, I do my live shot in the rain and got soaked. I got back into the studio at about 9:15 PM, about a half hour before my other story is to air. It's still being edited while I'm drying my hair for the studio live. Let me just say, wearing a 33 News baseball cap for 20 minutes in the rain makes for some seriously not ready for prime time hair. Sorry if I looked a mess last night, I did the best I could. I was thinking, maybe wear the cap in the studio. No, that would look really dumb. Oh, for that snap-on hair style I see so often on TV!

Mother Nature

She blew in hard and fast tonight in Cleburne.  We were there about 7:30pm and it went from warm and windless to cool and severely gusty in a matter of minutes.  

The rain came down so hard while we were driving that at times photographer Rudy and I had to roll down the side windows and look outside to see the roads clearly.  It was so loud on our rooftop, we had to yell at each other to communicate.  (Truth be told, that part was fun!)

The weather did make it difficult to do our jobs tonight, though.  It wouldn't allow us to go live in Cleburne or even in Fort Worth, as we tried to make our way some place safe.  Too much rain, too much lightning.

Is Cowboys Stadium Vulnerable to a Terror Attack?

As a reporter, sometimes you make the most unlikely connections. It was like that today for me while doing a story on a security alert issued for stadiums. I was outside Cowboys Stadium trying to talk with folks about the threat and I happened upon a woman who survived the 9/11 attack on the pentagon. What are the chances that a woman from Washington, D.C. would be touring Cowboys Stadium?

She was very interesting and offered advice about terror attacks. She says that no one should feel that it can never happen to them, because she says she is proof that it can happen to anyone. She urges sports fans to be on alert for anything suspicious, while enjoying the game.

There are no specific threats against Cowboys Stadium or any other arenas in North Texas, but security experts say crowded, public places are attractive targets for terrorists.

The story that won't go away

Yes, I'm talking about H1N1. The story formerly know as Swine Flu. Here we are, weeks away from the vaccine's arrival and hospitals are being swamped by people with flu-like symptoms. Because the seasonal flu hasn't arrived yet, it's believed that almost all cases are H1N1. Children's Medical Center in Dallas has new visitation requirements. Visitors with flu-like symptoms simply don't get in. In Austin, Dell Children's Hospital is so overloaded they have set up tents to take care of the sick. Remember, this is just H1N1. What if the seasonal flu turns out to be widespread? What if doctors and nurses get sick? What if teachers, police officers and fire personnel can't go to work? For the first time in years, the flu-season has arrived before Autumn begins. Stop me if you've heard this before: Wash your hands.

Barber Out For 1 - 2 Weeks

Looks like The Cowboys will be without their leading rusher for that Monday night game at Cowboys Stadium. Marion Barber, who injured his left quad during the 4th quarter of Sunday night's loss to The Giants, will be out for 1 to 2 weeks. Felix Jones will get the start Monday night against The Panthers.

Frisco Security

The system costs about 450-thousand dollars. This is really a neat program to see in real life. It can watch just about every corner of the school. I was surprised to know that while all of Frisco's schools have cameras, most of them don't have metal detectors. I was told that some portable wands are available, but it didn't sound like they were used often.

Frisco Security

Prior to the safe program first responders had to rely on paper maps, lists, and documents. Now, all the information is available electronically. Only select administrators and staff have access.
I do think this is the wave of the future as far as technology. Some people fear that they're private rights will be violated, but I think that concern is just about always there whenever something new comes along.

A new study finds that way too many medical students are putting private patient information on the internet. 60% of the medical school officials who took part in the study added that they were aware of students putting lewd pictures of themselves out there for just about anyone to see. Medical students learn early about the do's and don'ts regarding patient information. The few who don't listen in class may soon graduate from the school of hard knocks. Flozell Fined... Again!

Cowboys left tackle, Flozell Adams has the type of streak going that many people wouldn't want. For the second week in a row, Adams has been fined by The NFL. This week, the amount is a hefty $12,500, all for tripping Giants Defensive End, Justin Tuck, who was injured on the play. Flozell was also fined $5000 during the season opener for an unnecessary roughness penalty.

Spikes?


Arnold from Cumby, Texas had this comment about the wrong-way drivers on the N. Dallas Tollway.  His suggestion, disablement of the vehicle. He writes, "this could be done by using spike strips embedded in the concrete at the exit ramps."  Sound good to me, but apparently this idea has already been tossed around the NTTA boardroom. 
   Here is its response: "Roadway spikes, which many customers have suggested, are not an option because of the faster speeds that occur on a tollway compared to a parking garage or other location where cars travel slowly."  Next!

Chilling Final Plane to Tower Radio Transmissions

It was sad to hear the radio transmissions just released by the FAA of the fatal flight out of Dallas to Tampa.  Five people died.  The plane got into trouble going through a storm on its way to Tampa.  They were so close.  With all of our high tech weather radar and stuff in planes and in control towers these days,  it's hard for me to understand how this could happen.  The tower told the pilot to fly straight through the storm.  But, the pilot was not comfortable with that.  He wanted to go back.  Then the pilot realized he was upside down and in big trouble.  Eleven seconds later the plane disappears from radar.  Did the tower see a break in the storm straight ahead?  I never heard that on the radio transmissions. The pilot was told bad weather was ahead.  Why couldn't the pilot fly around it?  I'm not a pilot and I don't know how to manage planes from a control tower.  But, this is one of those sad stories you wish everyone could get a "do over."  Was the pilot to cocky or did the tower give the pilot wrong directions?  The NTSB is still investigating the official cause of the crash.  Blame or no blame, five families are grieving.  The pilot's final moments on tape are chilling.  I pray for the families of the pilot and passengers and I hope other pilots and controllers can learn something from this tragedy that will save lives in the future.  You can hear those radio transmissions in my report.

Dallas Terror Plot

It sounds like a movie. Disgruntled youth wants to blow up a 60 story building in downtown Dallas. Here is the scary truth: It's not a movie. According to the FBI it was planned and the kid wanted it to happen. We'll see when it goes to court, but I must say, the FBI and other agencies are working like crazy to make us safe. We never see it, the suspect never saw it, but there they are. My story regarding the alleged terror attact was to get reaction from people who work in the Fountain Place building. We got there so fast that we were breaking the news to them, in person. Most were stunned and scared. The buiding where they go to everyday to make a living may have been the place they died? A hard thing to hear. This story will likely be with us for days to come, with dribs and drabs of information regarding the suspect being released. The alleged plot reads like a  movie script, stick around for part two.

Sharing a Courtroom with a Suspected Terrorist

It isn't everyday that you stand just a few feet from someone accused of wanting to kill dozens of people and shatter a community. 19-year old Hosam Maher Smadi appeared calm and quiet in federal court. It's hard to imagine he is the man who federal agents say was happy to plant a bomb and blow up a building. The teenager whispered so softly that the judge had to tell him to speak up. He seemed courteous and well-groomed.

But, that is not the picture the FBI paints of Smadi. Court documents describe Smadi has someone hell bent on violent jihad, who was willing to take lives no matter what. We will have to wait and see how this plays out in court. Will he pled not guilty or guilty? How much evidence do the feds really have against him? Is there any credability to the family's claims that Smadi was set up? Just as like most stories. Time will tell and you can bet we will be watching.

State Fair Security

Well, I had to spend the day at the fair today...tough job right?! I really enjoyed myself. I actually got to ride the new green Dart line to Fair Park. I would highly recommend this form of travel. I paid two bucks and the train let me off at the front door of the fair. That is the way to go people...you don't have worry with ten dollar parking fees and police even say its them with security problems.

State Fair Security

I have never seen so many officers at a state fair. At one point I actually saw a secret service agent on top of the roof. I am sure that some of the security efforts were prompted by yesterdays foiled terror plot in Dallas. I can only say that you should really secure at the fair this year.

I was born in a small town

Redding, California to be exact. A little bigger than Italy, Texas, but still small. I can't imagine what it's like to live in a town of 2,000 and learn that one of your neighbors is accused of trying to blow up a 60 story office tower in downtown Dallas. That's what Hosam Haher Hussein Smadi is accused of. We went to the homecoming football game on Friday night and some fans were not pleased we were there. I don't blame them, but the follow story is obvious: How do you feel when there is an accused terrorist lived in your tight-knit community? Right under your very eyes? I'll throw a few words out and then close. Stunned. Amazed. Shocked. One man told us it had nothing to do with the football game and didn't want to talk about it. I don't blame him, but not talking about it won't make it go away. Good night.

Waitress Stunned

Well, this was another first for me. I basically had to spend the evening hanging out at the strip club. The ladies were all very nice there ( no fun intended). The security system inside Cabaret North is very sophisticated. I mean, I've seen banks that have had less surveillance cameras than this place. I imagine quite a few brawls can break out when there's booze and women around. The management was very helpful, thanks.

Waitress Stunned

I really felt bad for the victim in this. Can you imagine having 200 volts of power sent through your body? If your curious log on to Youtube and watch as grown men are shocked with the stun guns...it nearly knocks them off their feet. You can only imagine how it must feel to a women. The victim was bruised and scared. She's hoping to be able to get back to work next week. She's also hoping the suspect will be caught. I'm told police have already made several trips to the suspects home but have not been able to catch up with her yet.

Great View!












This week the Trinity Trust received a $10 million donation to turn the old Continental Avenue bridge into a pedestrian walk. The creative design includes a grassy park with tree covered walkways and bike paths. Just to the south of the bridge will be a great view of the new Margaret Hunt Hill Bridge which is located between Singleton Boulevard and Woodall Rodgers.

Muslim Reaction

I visited the Dallas Central Mosque today in Richardson. My interview, Anwar Taufique, spoke about how Muslims need the correct portrayal in the media. He basically said that whenever there is negative news about their faith they hear about it. I appreciated that he also felt Smadi had made a huge mistake like many young people do.

Muslim Reaction

Mustafaa Carroll was a very high energy interview. He has some strong views about Islam. He's basically saying that he doesn't appreciate the media showing up to the mosque whenever something happens with terrorism. I could appreciate what he was saying. I mean its true, whenever there's a shooting or something we don't really ask or report the name of the persons religion. Of course, I reminded Carroll that most criminals don't mention they're religion when breaking the law. He agreed.

School Closed

A Collin County middle school will be closed Monday after more than 250 students were absent Friday.  Parents say they had flu-like symptoms, including aches, sore throats and coughing.

Extracurricular activities were also called off for Monday and Tuesday.  School will resume Tuesday.

Marion Barber officially out of tonight's game

The Cowboys have released their list of inactives for tonight's game and Marion Barber headlines the list.  Also not paying tonight offensive linemen Montrae Holland, Pat McQuistan and Duke Preston, linebacker Jason Williams, wide receiver Kevin Ogletree and safety Mike Hamlin,

Maybe the Cowboys have been trying to convince themselves that in week three, this is a must win, but if it truly was, wouldn't Barber be in there? 

He participated in all four practices this week with the quad injury but the Cowboys say it was on a "limited basis" and Wade Phillips said on Saturday, if he was limited at game time, he would be an inactive.

Even today, Barber tried to talk the Cowboys brass into activating him but it apparently fell on deaf ears.

Another Taser Incident in Fort Worth

It isn't often that police whip out the taser inside a Walmart store, but it happened in Fort Worth. A 30-year old father of two says he was hit with the stun gun, while waiting at customer service to retrieve a lost wallet.

Antwone Freeman says he got upset and talked back to an off-duty officer working security, when he says the officer told him to "shut up". Freeman says he didn't deserve to be arrested for disorderly conduct and when he protested, he got tased 3 times. 

But, police tell a different story. They say Freeman was causing some problems and tried to use his 1-year old nephew as a human shield during the arrest. They also say an officer was head butted during the arrest.

Tamiflu or not to Tamiflu

Another young life lost to H1N1 and the seasonal flu is just around the corner. Usually about this time of year, we say things like: The cold and flu season is just around the corner. This year it never really left. People are now debating weather or not Tamiflu should be more wildely used after a 14 year old girl died of H1N1. Other than having swine flu, she was a healthy girl, which according to CDC guidelines, made her a candidate not to receive the antiviral drug. Tamiflu helps fight the flu. Some are saying the drug should be prescribed more often. We interviewed a doctor in Rockwall who told us he would rather error on the side of caution, and prescribes Tamiflu when he sees fit. He says the CDC issues guidelines, not laws. I'm not in the business of giving opinions, but I really hope when the flu season finally ends, we don't have any unused Tamiflu on the shelves.

An Accused Bomber's MySpace Page

So what would you expect to find on the MySpace page of a 19-year old Jordanian national, accused of plotting to blow up a Dallas skyscraper. Hosam Smadi's site uses the word "mobster". That is his web name. It also features a lot of references to pot and partying. 

It isn't exactly what you would expect to find on a terror suspect's social networking site. But it seems that Smadi isn't like others accused of similar crimes. According to friends, he partied hard and loved american movies. He reportedly visited Dallas clubs and wore black clothing, with a large belt buckle that had a gun on it. 

We should learn more about the terror suspect next week when he is back in court. So stay tuned.

Suspects in Cigarette Theft Burned

It happened in Mesquite early this morning.  Two men are accused of filling garbage cans with cigarettes stolen from a gas station and convenience store.  After leaving the store, the men allegedly wouldn't pull over for officers.  A chase ensued before the pair was arrested in Dallas.

Sure, quick police response and good police work both played a part.  But, what's being called instrumental in the pair's arrest may surprise you.

It is technology.  And it's pretty cool.

School Closure

Trinity Christian Academy will be closed from Wed-Friday...they will reopen on Monday. I was told that there are no football games scheduled, but there some volleyball matches. Any games that are missed will be rescheduled. All extracurricular activities have been canceled right now.

School Closure

I had the chance to talk with the maintenance staff at the school...they are very diligent from what I saw. They say the always disinfect, but this time they will give desks, etc. a good clean. I noticed several bottles of bleach wipes. Buses will also be cleaned. Trinity Christian Academy also keeps a nurse on staff..just in case.

"The Streak" Continues

"The Streak" is still alive. For the third week in a row, Cowboys Left Tackle Flozell Adams has been fined by the NFL. This time the league got him for $7500 for kicking Julius Peppers during The Cowboys Monday Night win over The Panthers. Wish I had that kind of money to throw away.

Deadline!

I had myself a four deadline day. One for the 5:30 show. One for the top of the 9:30 show and one for 9:30. If you're counting, here's deadline number four: The state mandated school vaccine deadline ended today and kids who didn't get their shots will be turned away from school tomorrow. Dallas County health officials can't believe how many parents missed the extended deadline to get their kids vaccinated. I feel very good about meeting my deadlines today. I won't gloat, because tomorrow I may wind up like many parents, on the expired end of the deadline.

Helping Samoa

If you haven't seen the video of the devastation in Samoa, it's heart wrenching. We talked with a young man from Mesquite who lost 9 relatives. They lived in a small coastal village that was flattened by the Tuesdays tsunamis. He spent the next 24 hours creating a website that he hopes will inform and connect the Samoan community here in North Texas.

Bring It On!!

I hear Mother Nature could pay us a loud and strong visit tomorrow afternoon.  I love the rain, the thunder and lightning, as well as the aftermath.  Puddles and mud!!

I've got my rain boots out already.  Yes, the ones with dogs on them.  Or wait, should I wear the ones with stripes?  Hmm.  What to do?  One of each?
