When is drunk driving, murder?

A Denton County family will be shattered forever. A mother and her teenage daughter are dead. A Stepdad and two other children are hurt. The man accused of causing all the misery is on parole for a string of DWI offenses and now this.

So, when is it appropriate for prosecutors to skip the intoxication manslaughter charge and just go for murder. It is happening more frequently in Texas, when repeat drunk drivers kill the innocent. Many times juries are willining to send these offenders away for decades.
